The Court of Appeal in a hearing on 26th June, 2013 disagreed with the assessment of damages by the Registrar for Pain, Suffering and Loss of Amenities. The Court in the exchange with Counsel said that the Registrar had not set out the reasons which led her to make the finding that the Respondent sustained moderate whiplash injury.
In light of the exchange between Counsels and the Court, the parties were able to arrive at a settlement of the various heads of damages, the subject of the appeal.
