In a ruling delivered by the Vice President of the Industrial Tribunal, Marilyn Meeres, Baycourt landed a win for a decision to terminate an employee based on three reprimands.
The Tribunal was satisfied that the Bahamas Telecommunications Company had good reason to terminate its employee for cause under the terms of its industrial agreement with the BCPOU.
The case confirms that an employer can use the weapon of termination in circumstances where an employee habitually and repeatedly breached company policies. The ruling also reaffirms that the burden of proof is on the applicant/employee to establish that the dismissal was wrongful or unfair.
