In a judgment delivered on 5th March, 2021 Justice Winder confirmed that occupiers liability is not strict liability.
The Ruling also confirms that the visitor has a duty to take reasonable precautions and can by her/his conduct accept the risk.
The plaintiff’s claim was dismissed.
