The Chief Justice in a clear and brief Ruling decides the case of two competing title holders by virtue of the provisions of the Limitation Act, 1995.
The Court reaffirmed that for the puposes of the Act the relevant limitation period will be the former 20 years once the action was filed prior to 2007.
The Defendant, represented by Mr. Rigby of Baycourt Chambers, was victorious in showing that he had been in undisturbed possession for 20 years or more.
